Terms of Service

Version 2.0 • Effective November 5, 2025

1. Agreement to Terms

By accessing or using Fire Mission ("the Platform") operated by Mark Christopher Consulting Group, LLC DBA Blackburn Tactical ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not access or use the Platform.

2. No Warranties or Guarantees

IMPORTANT DISCLAIMER:

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Mark Christopher Consulting Group, LLC DBA Blackburn Tactical makes NO GUARANTEE of:

  • Continuous, uninterrupted, or secure access to the Platform
  • Accuracy, reliability, or completeness of any AI-generated content
  • Freedom from errors, bugs, or system failures
  • Specific uptime percentages or service level agreements (SLAs), except where explicitly stated in Enterprise License agreements
  • Availability of any particular feature or functionality

You acknowledge and agree that your use of the Platform is at your sole risk.

3. Subscription Charges, Auto-Renewal, and Refund Policy

AUTO-RENEWAL NOTICE:

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can cancel your subscription at any time through your online account dashboard. No phone calls, emails, or other contact required for cancellation.

Express Affirmative Consent (State Law Compliance):

By clicking "Subscribe," "Sign Up," or "Create Account," you expressly acknowledge and consent to:

  • Automatic subscription renewal at the end of each billing period
  • Charges to your payment method until you cancel
  • The cancellation policy described in Section 4
  • The non-refundable policy for all subscription charges

NON-REFUNDABLE POLICY:

All subscription charges are PAID UP FRONT and are STRICTLY NON-REFUNDABLE in the following circumstances:

  • User-initiated cancellation for any reason (dissatisfaction, change of mind, etc.)
  • Technical issues or service interruptions
  • Inability to use features or functionality
  • Business-initiated termination for cause (ToS violation, payment failure, fraud)
  • Early cancellation of subscription (user-initiated)

EXCEPTION: If we terminate your subscription without cause (not for ToS violations, payment failures, or fraud), you will retain access until the end of your current paid billing period, ensuring you receive the full value of your prepaid subscription.

This exception applies only to business-initiated terminations without cause. All user-initiated cancellations and business-initiated terminations for cause result in immediate access termination with no refund.

4. Cancellation and Termination Policy

USER-INITIATED CANCELLATION:

You may cancel your subscription at any time through your online account dashboard by clicking "Manage Subscription" → "Cancel Subscription". You may cancel immediately or schedule cancellation for any future date.

UPON USER-INITIATED CANCELLATION:

  • Access terminates on the effective cancellation date
  • NO REFUND for any unused portion of your subscription period
  • NO PRORATED CHARGES will be calculated or credited
  • All session data purged per 30-minute retention policy

Example: Subscribe January 1st, cancel January 15th → Access ends January 15th, zero refund for remaining 15 days.

BUSINESS-INITIATED TERMINATION:

We reserve the right to suspend or terminate your account for:

  • Violation of Terms (e.g., abuse, illegal activity, terms breach)
  • Payment Failure (failed payment methods, chargebacks)
  • Fraudulent Activity (misrepresentation, unauthorized access)

Access Policy for Business-Initiated Termination:

  • For Cause (violations above): Access terminated immediately, NO REFUND
  • Without Cause (rare business decision): You retain access until the end of your current paid billing period, NO REFUND (you receive full value for payment made)

Example: Paid through March 31st, terminated without cause on March 15th → You keep access through March 31st.

Easy Cancellation (State Law Compliance):

Cancellation requires the same steps as sign-up: online account creation → online cancellation. No phone calls, chatbots, or mailed paperwork required. Cancellation link available 24/7 in your account dashboard.

5. Data Processing and Storage

Fire Mission operates under a "Process and Forget" security model:

  • All documents are processed in memory and immediately discarded after processing
  • Sessions expire after 30 minutes of inactivity
  • No raw document content is persistently stored on our servers
  • Metadata only is retained for audit and compliance purposes

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7. Acceptable Use

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

9. BYOK Model and Third-Party Services

Fire Mission operates on a BYOK (Bring Your Own Keys) model. You are responsible for:

  • Obtaining, maintaining, and securing your own API keys from third-party AI providers (OpenAI, Anthropic, Google, etc.)
  • Compliance with all third-party provider terms of service, acceptable use policies, and pricing
  • All charges incurred through your third-party API keys
  • Availability and performance of third-party AI services

We are NOT responsible for:

  • Third-party service outages, pricing changes, or policy modifications
  • Quality, accuracy, or compliance of third-party AI outputs
  • Suspension or termination of your third-party API access
  • Any disputes between you and third-party providers

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes our data collection, use, and protection practices. By using the Platform, you consent to the practices described in our Privacy Policy.

Fire Mission is designed to comply with applicable data protection regulations including:

  • Federal: COPPA (Children's Online Privacy Protection Act); HIPAA-ready architecture (Fire Mission is not currently HIPAA accredited); GLBA; FCRA; FedRAMP-aligned architecture (Fire Mission is not currently FedRAMP authorized — FedRAMP Moderate readiness is on the roadmap)
  • State Privacy Laws (20 states as of November 2025): We comply with comprehensive state privacy laws where they apply to users residing in those states, including California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Montana (MCDPA), Oregon (OCPA), Texas (TDPSA), Florida (FDBR), Iowa (ICDPA), Indiana (ICDPA), Tennessee (TIPA), Delaware (DPDPA), New Hampshire (NHDPA), Nebraska (NDPA), New Jersey (NJDPA), Maryland (MODPA), Minnesota (MCDPA), Rhode Island, Kentucky (KCDPA), and all other applicable state data protection and privacy regulations
  • International: GDPR (for EU/EEA users), with Standard Contractual Clauses for data transfers

Enterprise and Defense Edition deployments can be configured to align with additional sector-specific control baselines, including HIPAA-ready architecture, FedRAMP-aligned architecture (FedRAMP Moderate readiness on roadmap), SOC 2 (Type I in progress), ISO 27001, and DoW IL2-Top Secret control baselines. Fire Mission does not currently hold FedRAMP authorization, SOC 2 attestation, ISO 27001 certification, or DoW certification; see /trust for the canonical attestation status.

11. Intellectual Property

The Platform, including all software, designs, text, graphics, and other content, is owned by Mark Christopher Consulting Group, LLC DBA Blackburn Tactical and protected by US and international copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to documents and data you upload or process through the Platform. By using the Platform, you grant us a limited, non-exclusive license to process your content solely to provide the Platform services. This license terminates when you delete content or cancel your subscription.

AI-Generated Content: You are solely responsible for reviewing, validating, and ensuring compliance of all AI-generated content. We make no claims of ownership to AI outputs generated using your API keys.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mark Christopher Consulting Group, LLC DBA Blackburn Tactical, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your violation of any applicable laws or regulations
  • Content you upload, process, or generate through the Platform

13. Export Restrictions

The Platform may be subject to US export control laws and regulations. You agree not to export, re-export, or transfer the Platform or any related technical data to any country, entity, or person prohibited under US law, including countries subject to US trade sanctions or embargoes.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the Commonwealth of Virginia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

  1. Informal Resolution: Good-faith negotiation for 30 days
  2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, with arbitration conducted virtually or in the Commonwealth of Virginia
  3. Exception for Injunctive Relief: Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Enterprise License Agreement, constitute the entire agreement between you and Mark Christopher Consulting Group, LLC DBA Blackburn Tactical regarding the Platform and supersede all prior agreements, understandings, and communications.
